TERMS OF SITE USE

By using niro-technologies.myshopify.com and its subpages (the “Site”), and/or by purchasing products from Niro Technologies (hereinafter “Niro” “we” or “us”), you the customer (“Customer” or “you”) agree to the Terms of Site Use (referred to as “TOS”) as detailed herein, and agree to be bound by its terms and conditions.       

USE OF SITE AND THIRD PARTY APPLICATIONS

The Customer’s use of the Site is “as is” and without representation or warranty from Niro.  Niro did not create any of the computer software or links that you interact with on the Site; it has all been sourced from third-party vendors and creators.  We use it to sell products, and you agree that its use is “as is” as part of your interaction with Niro.  Niro does not and cannot provide any representation or warranty regarding operability or safety of the use of software, applications, web pages or applets, or third party links of any kind that are used on the Site.

PURCHASES

By purchasing a product or products from Niro, the Customer agrees to pay the amount posted on the site at the point of purchase, to provide a valid method of payment, and warrants that the Customer is at least 18 years of age.  All sales are made in US Dollars.  The Site does calculate costs of certain taxes and fees at the point of sale, but the Customer is ultimately responsible for and agrees to pay any such costs that are not posted, including those related to taxation in their home state or country, tariffs, foreign currency exchange, patriation of goods, and/or shipment, regardless as to whether they are initially charged to or advanced by Niro.

SHIPPING & PRODUCT AVAILABILITY

Niro promises to ship all orders to each customer as promptly as possible.  However, Niro does not make any warranty about the promptness of shipping due to the volume of orders of its product and the inherent nature of business.  Shipping may be affected by any number of factors that Niro may not be able to anticipate, including product availability, third-party shipping delays, acts of God, customs, or sheer customer distance from the source of the product sold by Niro.

RETURNS & EXCHANGES

Niro has a thirty-day return policy, whereby you may return a product purchased from Niro within thirty days of purchase for whatever reason, so long as the returned item is unused, in the same condition that it was received, and in the original packaging. 

The Customer is responsible for paying for shipping costs for returning each item. Shipping costs related to the original sale are non-refundable. If one item of several items is returned and you obtain a refund or exchange, Niro may, at its option, deduct any cost of return shipping from the refunded total.

Niro is happy to exchange any item that is visibly defective or broken.  A piece may not be exchanged, however, due to discoloration.  Niro cannot provide a warranty or representation as to the date for shipping an exchanged item, based on its worldwide customer base and shipping circumstances mentioned above.

The Customer must provide Niro notice of a return or exchange at: sales@NIRO-Tec.com.

REFUND PROCESSING

If Niro provides a refund pursuant to the above return policy, please expect a delay of 2-3 months in processing the return.  When at all possible, the Customers’ refund will be processed, and a credit will automatically be applied to your credit card or original method of payment.  However, institutional bank delays, posting delays, credit card company delays, and other such delays outside of Niro’s control might delay the process.  Please contact those institutions to check on the status of your refund, and if those parties cannot inform or resolve the delay, please contact us at sales@NIRO-Tec.com.

RIGHT TO REFUSE SALE

Niro reserves the right to refuse to fulfill or rescind any order placed on the site and return the payment amount to the Customer, if paid. Niro reserves the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors that are not otherwise authorized to sell Niro products.  We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order for this and any other reasons. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made.

PRODUCT DISCLAIMERS THAT YOU SHOULD KNOW:

In buying any products on the Site, you agree that you have read all notices and warnings on the Site, and will abide by them.  These notices and warnings include, but are not limited to the following:  

NOTICE

Niro warrants all products to be free of any defects and offers a full replacement of any product ordered by the customer for a period of 12 months from the shipment date.  In order the process warranty claims, the original product must be received for inspection and validation of deficiency being claimed.

INFORMATION COLLECTION AND PRIVACY

Niro naturally collects information from any users of the Site, including the Customer, and has three general policies regarding this information that are explained in detail here, and they: (1) we keep the information confidential; (2) we do not sell information to third parties; and (3) we do not advertise to your email address unless you consent for us to do so.

~SECTION 1 – INFORMATION COLLECTED & Confidentiality

When you purchase something from Niro on the Site, as part of the buying and selling process, we collect the personal information the Customers give us, such as your name, address and email address.  When you browse our store, we also automatically receive your computer’s internet protocol (IP) address in order to provide us with information that helps us learn about your browser and operating system.  This information is kept confidential, per the terms of this policy. 

~SECTION 2 – INFORMATION STORAGE

The Site is hosted on Shopify, Inc (hereinafter “Shopify”). Shopify provides us with the online e-commerce platform that allows us to sell our products and services to you.  Your data is stored through Shopify’s data storage, databases and the general Shopify application. They store your data on a secure server behind a firewall.

~SECTION 3 – CONSENT REQUIRED FOR MARKETING

We do not advertise to with your information you unless we receive your consent. When you provide us with personal information to complete a transaction, verify your credit card, place an order, arrange for a delivery or return a purchase, we imply that you consent to our collecting it and using it for that specific reason only.

If we ask for your personal information for a secondary reason, like marketing, we will either ask you directly for your expressed consent, or provide you with an opportunity to say no.  If after you opt-in, you change your mind, you may withdraw your consent for us to contact you, for the continued collection, use or disclosure of your information, at any time, by contacting us at:

~SECTION 4 - DISCLOSURE

Niro may disclose your personal information if we are required to do so by law, or in regards to a violation or potential violation of the TOS by the Customer.

~SECTION 5 –INFORMATION STORAGE TIMELINE OF SHOPIFY

If you choose a direct payment gateway to complete your purchase, then Shopify stores your credit card data. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is deleted.

All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover.  PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

~SECTION 6 - THIRD-PARTY SERVICES

In general, the third-party providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us.

However, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions.

For these providers, we recommend that you read their privacy policies so you can understand the manner in which your personal information will be handled by these providers.  In particular, certain providers may be located in or have facilities that are located a different jurisdiction than either you or us. So if you elect to proceed with a transaction that involves the services of a third-party service provider, then your information may become subject to the laws of the jurisdiction(s) in which that service provider or its facilities are located.

By way of example, if you are located in Canada and your transaction is processed by a payment gateway located in the United States, then your personal information used in completing that transaction may be subject to disclosure under United States legislation, including the Patriot Act.

Once you leave our store’s website or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy or our website’s TOS.  When you click on links on our store, they may direct you away from our site. We are not responsible for the privacy practices of other sites and encourage you to read their privacy statements.

~SECTION 6 - SECURITY

To protect your personal information, we take reasonable precautions and follow industry best practices to make sure it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed.  If you provide us with your credit card information, the information is encrypted using secure socket layer technology (SSL) and stored with an AES-256 encryption.  Although no method of transmission over the Internet or electronic storage is 100% secure, Niro follows all PCI-DSS requirements and implement additional generally accepted industry standards.

~SECTION 7 - COOKIES

Niro uses the following cookies to collect information:

 _session_id, unique token, sessional, Allows Shopify to store information about your session (referrer, landing page, etc).

 _shopify_visit, no data held, Persistent for 30 minutes from the last visit, Used by our website provider’s internal stats tracker to record the number of visits

 _shopify_uniq, no data held, expires midnight (relative to the visitor) of the next day, Counts the number of visits to a store by a single customer.

cart, unique token, persistent for 2 weeks, Stores information about the contents of your cart.

 _secure_session_id, unique token, sessional

 storefront_digest, unique token, indefinite If the shop has a password, this is used to determine if the current visitor has access.

COMPLETE AGREEMENT

Both the Customer and Niro that this TOS, along with any and all sales data and information regarding the purchase by Customer of any product on the Site, constitutes the complete and exclusive agreement between the two parties, for which sufficient consideration has been provided.  No other prior promise, written or oral, shall be construed to affect the Agreement unless reduced to writing and signed by both Niro and Customer.

LAW AND VENUE

Both Customer and Niro agree that any contract made with Niro by virtue of any use of this Site was executed and created in the State of Ohio and is governed by Ohio law. 

Both Customer and Niro agree that the proper venue for the adjudication of any dispute in regard to any activity on the Site between the customer and Niro is that court with jurisdiction closest to Chagrin Falls, Cuyahoga County, Ohio. 

CHANGES TO THIS PRIVACY POLICY & TOS

Niro reserves the right to modify these TOS and its privacy policy at any time, without notice, so please review it frequently. Changes and clarifications will take effect immediately upon their posting on the website. If our store is acquired or merged with another company, your information may be transferred to the new owners so that we may continue to sell products to you.
